Adjustments to the Accrual of Annual Leave

As per the Basic Conditions of Employment Act, an Employee is entitled to 1 hour Annual Leave for every 17 hours worked. Before mentioned Leave may not be paid to the Employees in cash value, during their employment, unless a variation, in the form of a Ministerial Determination, is granted by Department of Employment and Labour.Â
Nursetec applies for a Ministerial Determination, on an annual basis, on Annual Leave, for temporary personnel. The Ministerial Determination have awarded temporary personnel the option of having their Annual Leave being paid out, at an all-inclusive rate – an Employee would be paid their Annual Leave with every salary/wage pay-out.
The Department of Employment and Labour have suspended the Ministerial Determination Applications, of all Agencies, including Nursetec’s, until further notice. The suspension/delay in the Ministerial Determination application requires that Nursetec has to revert to normal prescription on Annual Leave, as relayed in the Basic Conditions of Employment Act.  Seeing as Nursetec will no Longer be allowed to automatically pay-out an Employee Annual Leave with each pay-out, this will lead to a 5.88% reduction in your rate per hour.
Nursetec will accumulate the 5.88%, toward every Employees’ Leave profile, which will entitle the Employee to notify Nursetec when he/she wants to take Leave, after which accumulated Leave credits will be paid to the Employee.

It is important to note, that even though the 5.88% will be deducted, the Employee does not forfeit this deduction, Nursetec merely accumulates it toward the Employee Leave Profile, and the accumulated amount will be payable to the Employee, upon request.

If at some stage, the Department of Employment and Labour Lifts the suspension on the Ministerial Determination, Employees’ will be notified, and the option for payment of Annual Leave, with every pay-out, will be made available again.
